Terms of Use
Plain-language terms for using FairFares. We are an information service — we find deals, you book directly with the airline.
1. Acceptance of terms
By accessing or using FairFares (the "Service") you confirm that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and ARAI, the operator of FairFares, registered in the Netherlands. We may revise these Terms at any time by posting an updated version on this page. The revision date is shown at the bottom. Continued use of the Service after changes are published constitutes acceptance of the revised Terms.
2. Service description
FairFares is a flight deal discovery service. Our automated pipeline monitors publicly available flight pricing data and alerts subscribers when fares drop significantly below their historical average. We are purely an information service — we do not sell flights, issue tickets, act as a travel agent, or enter into any booking contract on your behalf. No contract of carriage exists between you and FairFares. All bookings are made directly between you and the airline or third-party booking platform you choose. FairFares has no affiliation with, and is not endorsed by, any airline. We receive no commission or referral fees from airlines.
3. Price accuracy and availability
Flight fares are highly dynamic and can change or disappear within seconds. A price displayed on FairFares reflects data retrieved at the time our pipeline last ran; it may no longer be available when you click through. We make no representation or warranty — express or implied — that any fare shown is current, accurate, or will be honoured by the airline or booking platform. FairFares is not responsible for price discrepancies, booking errors, or additional charges (such as taxes, fees, or luggage costs) applied by the airline or platform. Always review the final price, fare rules, and booking conditions before completing a purchase.
4. User responsibilities
You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you must: (a) provide accurate information when creating an account or subscribing to alerts; (b) keep your login credentials confidential and notify us immediately at support@fairfaresapp.com if you suspect unauthorised access; (c) not use the Service to scrape, harvest, copy, or redistribute deal data at scale, whether manually or through automated means; (d) not attempt to probe, scan, or test the vulnerability of any FairFares system, or circumvent any security or authentication measure; (e) not submit, transmit, or promote unlawful, misleading, or harmful content through any part of the Service; (f) not use the Service in any way that could damage, disable, overburden, or impair our infrastructure. Automated access to the Service without prior written permission is strictly prohibited. We reserve the right to suspend or terminate accounts that violate these obligations.
5. Intellectual property
The FairFares name, logo, website design, interface elements, and any original written content are the intellectual property of ARAI and are protected by Dutch and international copyright and trademark law. You may not reproduce, distribute, modify, or create derivative works from our original content without our prior written consent. Flight price data displayed on the Service is sourced from public APIs and third-party providers; that data remains the property of the respective data owners. Nothing in these Terms grants you any licence to use ARAI's trademarks, trade names, or service marks. Personal, non-commercial use of the Service — such as viewing deals and clicking through to book — is permitted under these Terms.
6. Limitation of liability
The Service is provided "as is" and "as available" without any warranty of any kind. To the fullest extent permitted by applicable law, ARAI expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ARAI does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. To the maximum extent permitted by Dutch law, ARAI shall not be liable for: (i) any loss of revenue, profit, data, or goodwill; (ii) any indirect, incidental, special, punitive, or consequential damages; or (iii) any damages arising from your reliance on a fare that was unavailable, changed, or mispriced. In any event, ARAI's total aggregate liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the amount you paid to FairFares (if any) in the twelve months preceding the claim, or €50, whichever is greater.
7. Governing law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply. If you are a consumer resident in another EU member state, the mandatory consumer protection provisions of your country of residence continue to apply to the extent that Dutch law provides lesser protection.
8. Dispute resolution
We prefer to resolve disputes informally. If you have a complaint, please contact us first at support@fairfaresapp.com and give us a reasonable opportunity — at least 30 days — to resolve the matter. If we cannot reach an informal resolution, disputes shall be submitted to the competent court in Amsterdam, the Netherlands, which shall have exclusive jurisdiction, except where mandatory law requires otherwise. EU consumers may also use the European Commission's Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) to seek resolution.
9. Miscellaneous
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision does not constitute a waiver. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ARAI regarding the Service and supersede any prior agreements. We may assign our rights and obligations under these Terms without restriction. You may not assign your rights or obligations without our prior written consent.
